1. Welcome & Acceptance of Terms
1.1 Welcome, Architect, to The Modern Vitality Code (“Services”). The Services, including associated websites, online platforms, content, and coaching programs are operated by Architect Thorpe Mills (“Guide”, “we”, “us”, “our”). By accessing, browsing, registering for, and/or using our Services, you (“Architect” or “you”) agree to be bound by these Terms & Conditions (“Terms”).
1.2 IMPORTANT: Please read these Terms carefully in conjunction with our Disclaimer, Risk Assumption, Release of Liability, and Privacy Policy, as all four (4) documents collectively govern your relationship with us and are incorporated into these Terms. By accessing or using the Services, you warrant that you have the legal right, authority, and capacity to enter into and be bound by these Terms. If you do not agree with these Terms, the Disclaimer, Risk Assumption, Release of Liability, or the Privacy Policy, you must not use the Services.
1.3 We reserve the right to update, change, or replace any part of these Terms, the Disclaimer, Risk Assumption, Release of Liability, or the Privacy Policy by posting updates on https://thorpemills.com/home. It is your responsibility to check for changes. Your continued use of the Services following the posting of any changes constitutes acceptance of those changes. We will endeavor to notify active Architects directly of material changes to these Terms.
1.4 You must be at least 18 years old to access or use The Modern Vitality Code Services. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion. Acceptance as an Architect/client of The Modern Vitality Code is not confirmed until you receive a confirmation directly from us.
1.5 Any information freely provided on our Website or public platforms is for general informational and educational purposes only. The Modern Vitality Code focuses on holistic health coaching for Men & Women. We operate as drug-free practitioners and do not condone or provide guidance on performance-enhancing substances; use of such substances is at your own risk.
2. The Modern Vitality Code Services
2.1 Nature of Services: Guide provides coaching services aligned with The Modern Vitality Code framework (Fuel, Movement, Recovery, Clarity), tailored to individual Architect’s needs through defined programs (e.g., 1-1 coaching, group programs, membership, workshops, digital courses). Services may include personalised guidance, access to digital content, community forums, and direct communication. VITALITY CODE 1:1 TRAINING & EDUCATIONAL PROGRAM
Program Includes:
Initial comprehensive health and movement assessment
Personalized 8-week introduction training program with progressive adjustments
Bi-weekly 1:1 coaching sessions (15-20 minutes each, 4 total sessions)
Custom nutrition guidance and meal planning templates
Access to educational video library and module content
Recovery optimization protocols and sleep management strategies
24/7 app-based communication and support access
Progress tracking dashboard with performance metrics
Habit formation frameworks and implementation guides
Weekly check-ins and program modifications as needed
Program Duration: 8 weeks from enrollment date
Delivery Format: Hybrid model offering both in-person and virtual session options (subject to location and availability)
Educational Components: Access to structured learning modules, demonstration videos, meal planning resources, and habit-building frameworks provided via dedicated platform
Support Level: Direct access to lead trainer throughout program duration with response timeframe of 24-48 hours for non-urgent inquiries
Assessment Requirements: Completion of initial health questionnaire and movement assessment required before program commencement
Program Modifications: Training and nutrition protocols subject to adjustment based on individual progress, limitations, and goal evolution
This program is designed for individuals committed to building sustainable health practices through personalized coaching and structured educational content over a 8-week engagement period.
VITALITY CODE GROUP PROGRAM (6 WEEKS)
Program Includes:
Initial group orientation and movement screening session
6-week structured training program with weekly progressions
Weekly group coaching sessions (60 minutes each, 6 total sessions)
Foundational nutrition guidance and meal planning templates
Access to educational content library and movement demonstration videos
Recovery protocols and stress management strategies
Group support community via dedicated platform
Weekly progress check-ins and program modifications as needed
Group challenges and accountability partnerships
Progress tracking tools and habit-building frameworks
Program Duration: 6 weeks from program start date
Delivery Format: Group sessions conducted in-person or virtually based on program offering and location availability
Group Size: Maximum of 12 participants per cohort
Educational Components: Structured learning modules covering movement foundations, nutrition basics, recovery principles, and sustainable habit formation delivered via dedicated platform
Support Level: Group coaching environment with Q&A opportunities during scheduled sessions and community support access between meetings
Assessment Requirements: Completion of health questionnaire and basic movement screening required before program commencement
Attendance Policy: Regular attendance at weekly sessions required for optimal program benefit and community cohesion
Program Modifications: Training protocols designed for group setting with individual modifications provided for limitations or progressions as needed
Community Access: Dedicated platform access limited to program duration plus 2-week post-program period
This program is designed for individuals seeking community-based support and structured guidance to build foundational health practices in a collaborative 6-week group environment.
ONE-TIME PRODUCT DESCRIPTIONS
VITALITY MINIMAL CODE
3 Day Strength Plan / Daily 15 Versions:Complete 12-week foundational program designed for those new to structured health building. Includes basic movement routines (3 days/week OR 15 minutes a day of training), simple nutrition guidelines, and essential recovery protocols. Perfect for establishing sustainable habits with minimal time commitment and equipment.
VITALITY HYBRID CODE
Beginner Version: Comprehensive 12-week program combining guided structure with personal flexibility. Includes moderate movement programming (4-6 days/week), balanced nutrition approach, and integrated recovery methods. Ideal for those wanting more variety while maintaining sustainable progress with the intent of being able to run a 1/2 marathon at the end.
Accelerator Version: Advanced 12-week hybrid system featuring intensive training cycles, sophisticated nutrition periodization, and dynamic recovery protocols.
Comprehensive 12-week program/educational course combining guided structure with personal flexibility. Includes advanced movement programming (6 days/week), balanced nutrition approach, and integrated recovery methods. Designed for experienced individuals seeking maximum results through strategic variation and progressive overload. With the intent of running a sub 2 hour 1/2 marathon at the end of the program.
VITALITY MAXIMAL CODE
Beginner Version: 12-week program/educational course to high-level health optimization. Features structured daily protocols covering advanced movement patterns, detailed nutritional strategies, and comprehensive recovery systems. Built for committed beginners ready for serious transformation.
Accelerator Version:12-week program/educational course optimisation system for advanced practitioners. Includes complex movement programming, precision nutrition protocols, and cutting-edge recovery techniques. Designed for experienced individuals pursuing peak performance and maximum health potential.
Delivery: Digital download with lifetime access to all materials, video demonstrations, and program updates.
2.2 Scope of Practice: Architect understands that Guide is a Health & Fitness Coach and NOT a licensed medical professional, therapist, registered dietitian, or nutritionist. Guide does not diagnose, treat, or solve medical conditions, nor is the Guide a replacement for licensed healthcare providers. The Services are designed to provide education, guidance, and support, and are not substitutes for professional medical advice, diagnosis, or treatment. Aligned with these services, we provide tools and information to encourage Architect to be an active agent in their own life.
2.3 Prior to commencing any physical activity or significant changes in diet or recovery habits recommended by Guide, Architect is required to complete a Physical Activity Readiness Questionnaire (PAR-Q). PAR-Q is a separate form outside the main agreement. If Architect answers “Yes” to any PAR-Q question, or has any pre-existing health conditions, medical concerns, or is pregnant, Architect MUST consult with a physician before commencing Services and I will need to be sent / see written clearance from a doctor if the condition will play a major role in impacting the client, and at the clients will, and if they agree to proceed without doctors clearance they will need to fill out another form to proceed within the program if the coach is happy to do so, the client is therefore responsible of the potential risks. Guide reserves the right to request medical clearance or terminate services if safety concerns arise (refer to Termination clause). Architect is responsible for reporting any changes in their medical condition or any new symptoms to both Guide and their physician. Architect fully understands that changes in both diet, movement and recovery can and will have effects on their health and wellbeing. Architect takes full responsibility for communicating needs, symptoms and information to the Guide.
2.4 Results: While Guide provides expert guidance and a proven framework, Architect understands that results are not guaranteed. Outcomes depend significantly on Architect’s consistent effort, adherence to principles, unique biology, circumstances, honest communication, and external factors beyond Guide’s control. Architect is responsible for applying principles and taking action. Testimonials or examples provided are not a guarantee of similar results.
3. Program Investment, Payment & Refunds
3.1 Agreement to Pay: By committing to a specific Modern Vitality Code program (e.g., membership, 6 week program, 1-1 coaching or digital products), Architect agrees to the defined program investment and payment schedule as outlined in the specific program documentation presented at the time of purchase. Prices are confirmed at the time of commitment.
3.2 Payment Terms: Payments are due as per the agreed schedule. Late payments may incur a late fee of 10% on top of every 24hrs after the first 48hrs of the late payment. Failure to make timely payments 3 days may result in the suspension or termination of access to Services, digital content, community access, and all associated rights without further notice. We reserve the right to pursue collection of outstanding debt.
3.3 Refund Policy: All investments in The Modern Vitality Code Services are generally non-refundable. Due to the nature of comprehensive coaching, upfront program design, tailored guidance, and immediate access to digital content (The MMC Wisdom Library in other words the educational course), refunds are not provided for unused portions or cancellation by the Architect, except as explicitly stated otherwise in the specific written documentation for a program offering (e.g., a specific challenge or introductory trial with an advertised guarantee). By agreeing to these terms, Architect waives any right to claim a refund for services already paid for or accessed, outside of such explicit guarantees. For certain subscription-based Services, Architect may cancel their subscription as outlined in Section 8, but no refunds will be provided for partial subscription periods. If Guide terminates Services due to Architect’s violation of these Terms, no refund will be issued. You have the first 14 days to claim for a refund. To claim your refund within the first 14 days of opting into the programs you will need to reach and message your coach who will handle the refund with you.
3.4 Payment Processing: Architect agrees that Guide is authorized to charge provided payment methods for agreed-upon fees, including recurring subscription fees. Architect is responsible for providing valid payment information, ensuring sufficient funds are available, and notifying Guide promptly of any changes to payment information through the designated method (Account Settings), and if you have any problems reach out to your coach and he will guide you.
3.5 Price Changes: Prices for Services are subject to change upon notice (via Website, email, or direct communication), but changes will not affect programs already purchased or active subscription periods. For subscription services, changes will take effect at the beginning of the next billing cycle following notification.
3.6 Taxes: Architect is responsible for any applicable sales taxes, value-added taxes (VAT), or other taxes or duties associated with the purchase of Services, as determined by applicable laws and regulations in Architect’s jurisdiction.
4. Intellectual Property & Confidentiality
4.1 Ownership: All content, materials, methodologies, programs, videos (The MMC Wisdom Library), trademarks, logos, graphics, website design, software, code, and other intellectual property (“Architectural Intelligence”) comprising The Modern Vitality Code Services are the exclusive property of Architect Thorpe Mills or its licensors and are protected by copyright, trademark, and other intellectual property laws.
4.2 Limited Use License: Architect is granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services and Architectural Intelligence solely for Architect’s personal, non-commercial use and transformation during their active service period, subject to the terms of their specific program.
4.3 Restrictions: Architect shall not copy, modify, distribute, sell, lease, sublicense, reverse engineer, create derivative works from, or attempt to extract the source code of the Services or Architectural Intelligence. Architect shall not use Architectural Intelligence for any commercial purpose, business endeavour, or to coach, train, or share with others outside of themselves. Architect agrees not to remove any copyright notices or other proprietary markings from the Services or Architectural Intelligence.
4.4 Confidentiality - Architect’s Information: Guide will handle Architect’s personal information in accordance with the Privacy Policy . Guide will respect Architect’s privacy regarding their personal Health Wealth journey.
4.5 Confidentiality - Shared Journeys & Testimonials: Guide may use anonymized data, case studies, or aggregated patterns from Architect’s journey for educational, research, or marketing purposes, focusing on program impact and principle application, but without revealing Architect’s full identity. Guide will always request and receive explicit written consent (separate from these Terms) before using Architect’s full name, any identifiable information, likeness, or specific personal details in testimonials, shared case studies, or promotional materials. Architect has the right to review and approve the final content before publication.
5. Website & Third-Party Links
5.1 Our website(s) and platforms (https://thorpemills.com/home) provide information about The Modern Vitality Code and access to Services. The content is for general education and service access. We strive to keep the website accurate, but we do not guarantee the absence of errors or interruptions.
5.2 The Services may contain links to third-party websites or resources. Guide is not responsible for the availability or accuracy of such external sites and does not endorse their content, products, or services. Architect proceeds to such links at their own risk. We disclaim all liability for your use of any third-party websites, apps, or resources.
6. Architect & Guide Expectations (The Council Dynamic)
6.1 Architect’s Responsibility: Architect agrees to actively engage with Guide, provide honest and accurate information, maintain open communication, attend scheduled sessions (if applicable), be present, and prepared to fully participate in the Services and diligently apply the principles. Architect acknowledges that their results are dependent on their effort, commitment, and honest participation.
6.2 Communication: Architect is responsible for initiating contact for support, sharing progress, asking questions, and providing feedback via the agreed-upon channels (e.g., check-in calls/sessions, messaging app) within Guide’s stated communication hours (8am-5pm). Guide will respond within a reasonable timeframe (24hrs response time for 1-1 coaching and 6 week programing + further programs from the initial group programs, and 72hrs for the digital products business hours. Guide is not obligated to respond to communications outside of stated hours or through unauthorized channels.
6.3 Guidance: Guide will provide coaching, feedback, and make adjustments to Architect’s blueprint based on their active engagement, proactive communication of progress, and shared insights. Guide will provide comprehensive nutrition guidance based on MMC principles, but does not provide detailed meal planning unless explicitly part of a specific program. Guide’s advice is for educational and guidance purposes only, and Architect is ultimately responsible for all decisions related to their health, nutrition, and lifestyle.
7. Community Forum (If Applicable)
7.1 If access to a private community forum is provided, Architect agrees to use it lawfully and respectfully in accordance with these Terms, any forum rules, and general community guidelines. Prohibited content includes libelous, defamatory, offensive, abusive, harassing, stalking, threatening, racially or ethically objectionable, spam, or unlawful material of any kind. Respect the experiences of other community members and the space that that community seeks to provide.
7.2 Guide reserves the right to moderate content, suspend accounts, and remove anything deemed inappropriate, disruptive, or harmful to the community, Guide’s reputation, or in violation of these Terms. This includes but is not limited to posts making unauthorized claims, giving advice that can be considered out of alignment with the guiding principles
7.3 Guide is not responsible for content posted by other members and does not endorse their opinions or advice. Interaction is for peer support and shared experience. Do not treat the advice or experiences of others as concrete for their own journey.
7.4 Any links posted by users in the community forum are the sole responsibility of the user who posted the link. Guide is not responsible for the content, accuracy, or availability of any linked websites or resources.
8. Cancellation and Termination
8.1 underline{Subscription Cancellation by Architect: Architect may cancel a recurring subscription at any time before the next billing cycle begins through the designated method (e.g., account settings on the website, contacting Guide directly via email at [email protected]). Cancellation stops future billing, but no refunds are provided for amounts already paid or for the remaining period of a commitment term.} Architect should retain confirmation of their cancellation request.
8.2 Termination by Guide: Guide may terminate Architect’s access to Services at any time and without cause, with cause including but not limited to: violation of these Terms, non-adherence to agreed fundamental actions, safety concerns (including updates to PAR-Q), failure to make required payments, disruptive or disrespectful behavior toward Guide or other community members, misrepresentation of information, or any action deemed detrimental to The Modern Vitality Code brand or community. Upon termination by Guide, all rights cease immediately, and any outstanding fees for the agreed term remain payable, with no refund for the unused portion. Guide will take termination seriously, but must maintain the quality of service within the system.
8.3 Consequences of Termination: Upon cancellation or termination by either party, Architect loses all rights to access the Modern Vitality Code content, community, and any personalized Services from the Guide. Sections related to Intellectual Property, Confidentiality, Limitation of Liability, and Governing Law survive termination.
9. Force Majeure
Guide shall not be liable to Architect for any failure or delay in performance of the Services caused by events beyond Guide’s reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, government regulations, strikes, epidemics, pandemics, communication line failures, power outages, or internet disruptions (a “Force Majeure Event”). Guide will use reasonable efforts to notify Architect of any Force Majeure Event and to resume performance as soon as reasonably practicable. If a Force Majeure Event prevents Guide from providing a material portion of the Services for more than [Number] days, Architect may terminate the remaining portion of the Services and will be entitled to a pro-rata refund of any prepaid fees for Services not yet provided.
10. General Legal Terms
9.1 Disclaimer: Information provided through The Modern Vitality Code Services is for educational purposes only and should not be considered medical, legal, financial, or professional advice. Results vary. By using the Services, Architect accepts full responsibility for any outcome and releases Guide from liability as per the Risk Assumption and Release of Liability sections below.
9.2 Risk Assumption: Architect acknowledges the inherent risks of physical activity, lifestyle changes, nutritional changes, and participation in coaching programs. These risks may include, but are not limited to, muscle strains, sprains, injuries, aggravation of pre-existing conditions, emotional distress, and other unforeseen health consequences. Architect fully assumes all such risks and acknowledges that their participation in the Services is voluntary.
9.3 Release of Liability: To the fullest extent permitted by law, Architect hereby releases, waives, discharges, and covenants not to sue Architect Thorpe Mills, The Modern Vitality Code, its owners, directors, officers, employees, contractors, agents, and licensors from any and all claims, liabilities, demands, actions, causes of action, damages, losses, or expenses of any kind, arising out of or in any way connected with Architect’s participation in the Services, including but not limited to any injury, illness, death, or property damage, whether caused by the negligence of Guide or otherwise. This release extends to any claims that Architect does not know of or suspect to exist in their favor at the time of agreeing to these terms. This also applies to damages, claims or liabilities caused by third parties and not directly by Architect Thorpe Mills
9.4 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Kent, without regard to its conflict of law principles. Any legal action or proceeding relating to these Terms or the Services shall be brought exclusively in the courts located in Kent.
9.5 Entire Agreement: These Terms, together with the Disclaimer, Risk Assumption, Release of Liability, and Privacy Policy, constitute the entire agreement between Guide and Architect regarding the Services and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
9.6 Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed replaced by a valid, enforceable provision that most closely reflects the original intention.
9.7 Assignment: Architect may not assign or transfer any of their rights or obligations under these Terms without the prior written consent of Guide. Guide may assign or transfer its rights and obligations under these Terms to any affiliate or successor in interest without notice.
9.8 Notices: All notices required or permitted under these Terms shall be in writing and shall be deemed given: (a) when delivered personally; (b) one business day after deposit with a commercial overnight courier for next-day delivery; © when sent by confirmed email to the designated email address; or (d) three business days after deposit in the United States mail, postage prepaid, certified or registered, return receipt requested. Guide’s designated email address for notices is [Your Designated Email Address].
11. Acceptance
BY ACCEPTING THESE TERMS AND COMMENCING THE MODERN VITALITY CODE SERVICES (INCLUDING COMPLETING THE PAR-Q AND ACKNOWLEDGING THE RISK ASSUMPTION AND RELEASE OF LIABILITY SECTIONS), I, THE UNDERSIGNED ARCHITECT, ACKNOWLEDGE THAT I HAVE READ, UNDERSTOOD, AND AGREE TO ALL SECTIONS OF THESE TERMS & CONDITIONS, AS WELL AS THE DISCLAIMER, RISK ASSUMPTION AND RELEASE OF LIABILITY FORM. I UNDERSTAND THE NATURE OF THE SERVICES, THE RISKS INVOLVED, THE PAYMENT AND REFUND POLICIES, AND MY OBLIGATIONS. I CONFIRM MY RESPONSIBILITY FOR CONSULTING WITH APPROPRIATE MEDICAL PROFESSIONALS REGARDING MY HEALTH.
