These are the terms and conditions on which we supply digital content to you, including but not limited to online programs, courses, ebooks, templates, and other digital resources.

Please read these terms carefully before making any purchase on our site. These terms tell you who we are, how we will provide digital content to you, refunds and returns policies, and other important information.

By purchasing any digital content from The Vitality Code, you confirm that you accept these terms and agree to comply with them.

We may amend these terms from time to time. Every time you wish to purchase digital content, please check these terms to ensure you understand the terms that apply at that time.

We are Thorpe Mills Ltd, trading as The Vitality Code, a health and performance coaching brand.

3. Our contract with you

How we will accept your order

Our acceptance of your order will take place when we send you an email confirmation, at which point a contract will come into existence between you and us.

If we cannot accept your order

If we are unable to accept your order, we will inform you of this and will not charge you for the digital content.

4. Our rights to make changes

Coaching Calls and Digital Programs

The Vitality Code reserves the right to amend the time, date, or format of any 1:1 coaching sessions, live workshops, or group programs purchased. This does not entitle you to a refund or discount.

Minor changes to products

We may make minor changes to digital content:

• to reflect changes in relevant laws or regulatory requirements; and
• to implement technical adjustments or improvements that do not materially affect your use of the content.

5. Digital Content Delivery

For one-off purchases of digital content, your access will begin immediately once your payment has been successfully processed and confirmed.

6. Refunds and Cancellations

Digital content

Due to the instant-access nature of our digital products, once payment has been made and content delivered, you do not have the right to cancel or request a refund unless otherwise specified below.

Money-Back Guarantee

The Vitality Code offers a limited money-back guarantee under the following conditions:

Within 3 months of purchase, you must:

• Have not consumed more than 15% of the course or product.
• Provide clear evidence that you have completed all suggested actions in the portion of the course or content you have accessed.
• Provide reasonable evidence that you have not seen measurable improvement or value as a result of implementing the course material.

Evidence may include activity logs, screenshots, or written summaries of completed actions. Each refund request will be reviewed on a case-by-case basis, and eligibility will be determined by The Vitality Code team.

This policy does not apply to subscription plans, recurring memberships, or partial payment agreements. Once you enter into a split payment (e.g., 2- or 3-part payments), you are legally bound to complete all payments in full.

7. Price and Payment

The price of the product will be displayed on the checkout or order pages at the time of purchase.

Payment methods

Payment must be made in full unless an approved payment plan is offered. We may use secure third-party payment processors to handle your payment.

8. How we may use your personal information

We will only use your personal information as set out in our Privacy Policy.

9. Non-Disclosure and Intellectual Property

You acknowledge that by purchasing products or programs from The Vitality Code, you gain access to proprietary intellectual property and trade secrets belonging to Thorpe Mills Ltd, including but not limited to:

• course materials, templates, and frameworks
• training methodologies, written or verbal advice
• business and performance strategies
• mindset and habit-building tools

You agree not to share, copy, distribute, or repurpose any material obtained through The Vitality Code for commercial use, resale, or redistribution without prior written consent.

Any violation of this agreement may result in legal action.

10. Testimonials and Public Commentary

By submitting testimonials, feedback, or comments — including on social media, email, or within program communities — you grant The Vitality Code a non-exclusive, irrevocable license to use, publish, and distribute such content for marketing and promotional purposes across social media, advertising, and digital platforms.

No payment or additional services will be provided in return for testimonials.

11. Disclaimer

All advice and information provided through The Vitality Code reflect personal experience and professional opinion. We make no guarantees or representations regarding specific outcomes, fitness results, or business success.

All content is for educational and informational purposes only and should not replace medical, nutritional, or professional advice. You are responsible for applying all information safely and appropriately to your personal circumstances.

12. Transfer of Rights

We may transfer our rights and obligations under these terms to another organisation. You may not transfer your rights without written consent from us.

13. Enforcement and Delay

If we do not enforce a provision immediately, it does not mean we waive our right to enforce it later.

14. Which laws apply

These terms and any disputes arising under them are governed by UK law, and you agree that the courts of England and Wales shall have exclusive jurisdiction.
